Since 1997, Mr. Mostafa has built an impressive career as a civil litigator, representing major multinationals in complex litigation proceedings before the Egyptian Court of Appeals and Supreme Court.
Mr. Mostafa has over 27 years of diverse experience in the field. He has pursued postgraduate studies, earning an LLM from King’s College London, where he focused on the tension between Competition Law and Intellectual Property Law in the pharmaceutical sector. His dissertation, titled “Misleading Public Authorities in Evergreening as Anti-Competitive Practice,” demonstrates his deep understanding of these complex legal issues.
Mr. Mostafa has specialized in IP litigation during his work for Ibrachy and Dermarkar Law Firm. He has successfully defended the interests of pharmaceutical originators against generic companies, leading to the cancellation of registrations for generic pharmaceutical preparations and the removal of these products from the records of the Egyptian Drug Authority. His extensive involvement in these disputes has allowed him to address comprehensive IP issues, such as the application and interpretation of the Bolar Exemption and Compulsory License and contribute to the establishment of new judicial principles in the Egyptian jurisdiction.
Mr. Mostafa has also achieved significant victories in IP litigation related to the oil and gas sector. He successfully defended the IP rights of one of the largest companies in the industry, resulting in the removal of the CR and trademarks of the infringer. Mostafa also won counter actions for the cancellation of trademarks owned by the oil and gas company, further solidifying his track record of success. He successfully defended French and multinational cement companies in upholding an acquisition agreement with the Egyptian Government to acquire a public cement company. His contributions to the teamwork showcased the agreement’s legitimacy, which was concluded in good faith through public bidding. The court dismissed the lawsuit, affirming the validity of the transactions.
